Any use of ‘Site’ shall be deemed to include derivatives of the website, which include but are not limited to the websites and applications of SoleAsia, accessed via your mobile phone, tablet, or any other device.
OUR SCOPE OF SERVICES:
SoleAsia provides a means for you to browse and make reservations with various types of Accommodations via this Site. An offer to book a reservation, at the price listed for such reservation and such other terms and conditions stated on the Site, is made when a booking is made by you via this Site. Once the Accommodation confirms the reservation and SoleAsia accepts the offer, it shall become a binding contract. SoleAsia reserves the right to reject bookings as set out below. Acceptance of your Accommodation booking will be expressed via an e-mail confirmation with the details of the Accommodations booked.
The Accommodation details listed on the Site is based on the information provided to SoleAsia by Accommodation Suppliers. We will use commercially reasonable skill and care in rendering our services. However, the customer understands and agrees that SoleAsia will not validate and cannot guarantee that the information listed is accurate, complete, correct or up to date, nor shall SoleAsia be held responsible for any errors (including manifest and typographical errors), interruptions to service whether due to any temporary and/or partial breakdown, repair, upgrade or maintenance of the Site or otherwise, inaccurate, misleading or untrue information or non-delivery of information. Accommodation Suppliers or their representatives are given a connectivity solution to the Site and are therefore responsible for updating information regarding Accommodations such as rates, availability, description, pictures, booking conditions, accommodation policies posted on the Site and are therefore at all times responsible for displaying accurate, complete and correct information regarding Accommodation listed on the Site. Where problems are caused by the information displayed on the Site being inaccurate or outdated, please notify us and our Customer Service will use commercially reasonable efforts to assist and serve as a point of contact with the Accommodation for the Customer.
Search results may show rooms for a particular accommodation to be unavailable which means the room type is not available for reservation through SoleAsia, since SoleAsia is one of many channels Accommodations use to make their inventory available for reservation.
An Accommodation being listed does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or rating of the Accommodation by the Site. SoleAsia hereby expressly disclaim any representation, warranty or undertaking in relation to the quality, status or adequacy of any Accommodation listed on the Site. Accommodations listed on the Site can be ranked according to either star rating or reviews. Where Accommodations are offered the option to get a sponsored listing under certain circumstances, it will be marked or indicated as such for transparency.
Independent of the origin of errors, in rare cases, SoleAsia may have to cancel or reject a booking or make adjustments due to “obvious errors”, which is a mistake on the Site as to price, conditions, etc., which a reasonable person would not consider to be normal. In such cases, the booking will be adjusted, or where applicable, the amount charged will be reimbursed free of charge. The customer understands and agrees that SoleAsia reserves the sole discretion whether to cancel or reject a booking for this reason.
Please note that most Accommodations have specific procedures for group bookings, therefore, suspected group bookings can also be rejected or cancelled by SoleAsia or the Accommodation. Please contact our Customer Service team for more information.
Kindly keep in mind that the quality of your stay can be affected by circumstances such as ongoing renovations, Accommodation booking errors, and specific guest needs. Please ensue that any special requests or requirements are informed to the accommodation at check-in.
For the sake of clarity, any complaints with regard to the Accommodation description not being met, must be resolved independently between the customer and the Accommodation, as SoleAsia disclaims all responsibility or liability with regard to the descriptions provided by the Accommodation suppliers. However, customers are advised to notify SoleAsia of such misinformation so that we may contact the Accommodation to update or correct such misinformation on the Site, as well as try to use commercially reasonable efforts to act as a point of contact for the Customer to the Accommodation.
‘Accommodation’ refers to all lodging and temporary accommodation listed on our Site, including but not limited to hotels, hostels, serviced apartments, B&Bs, rooms for rent, cottages, villas, safari boats etc.
‘Accommodation Supplier’ refers to providers and suppliers including but not necessarily limited to the Accommodations, their representatives, distributors, destination management companies (DMCs), channel managers, partners, etc.
The Customer understands that star ratings are for your information only, and serves only as an indicative to the level of comfort you may expect at an Accommodation, with higher ratings indicating a higher level of comfort and amenities. If you require more detail, please refer to the detailed description of the Accommodation provided on our Site.
Please be aware that star ratings do not mirror all the amenities or services that may be available at an accommodation, and some amenities and features may not be available in every room or at every property with a particular star rating. If you would like to ensure that particular amenities or services are available to you, please inquire their availability by contacting our Customer Services.
Despite same star rating given to two different Accommodations, please note that star ratings may not be comparative to one another due to multiple factors which may cause it to vary such as location, available alternatives nearby, local market conditions, practices and such other circumstances.
Please understand that the star ratings are provided based on the information we acquire from our suppliers, and SoleAsia does not independently verify star ratings for each Accommodation listed on our Site. The Customer therefore understands and agrees that SoleAsia will not be held liable for any customer dissatisfaction from an inaccurate star rating.
USE OF THE SITE
As a condition to use the Site, directly or indirectly through any means included, including but not limited to the use of our customer services, you agree and warrant that you are:
1. You are at least 18 years of age and possess the legal capacity to enter into binding agreements;
3. You shall only use the Services to make bona fide and legitimate enquiries and reservations for yourself or for another person for whom you are legally authorized to act on behalf of;
4. You will not make any false, fraudulent or speculative bookings or reservations in anticipation of demand for yourself or for another person for whom you are legally authorised to act;
6. All information supplied by you to the Ste, including but not limited to the payment details while making a booking, e-mail address, postal and other such contact details of yourself, are fully correct, current, and complete;
7. You acknowledge and agree that SoleAsia may use the aforesaid information to reach you which SoleAsia find it necessary in any circumstance;
8. you are not covered by any international sanction program by making a reservation on the Site;
9. As far as SoleAsia is concerned, if and when applicable, you shall satisfy all your obligations, tax, withholding or otherwise as maybe required by your country of residence;
10. You shall safeguard your account information and will supervise and be completely responsible for any use of your account by yourself or any person other than yourself; and
Accordingly, you agree not to use the Site in the following manner (Prohibited use):
2. make any speculative, false, or fraudulent booking;
3. access, monitor or copy any content or information of the Site using any robot, spider, scraper or other automated means or any manual process for any purpose without our express prior written permission;
4. violate the restrictions in any robot exclusion headers on the Site or bypass or circumvent other measures employed to prevent or limit access to the Site;
5. take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
6. deep-link to any portion of the Site (including, without limitation, purchase paths) for any purpose without our express prior written permission;
7. re-sell, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on the Site for any commercial or competitive activity or purpose;
8. "frame", "mirror" or otherwise incorporate any part of the Site into any other website without our prior written authorization;
9. deliver any unlawful (according to any and all applicable laws or regulations) postings to or through the Site, or any postings which advocate illegal activity;
10. deliver, or provide links to, any postings containing material that could be considered harmful, obscene, pornographic, indecent, lewd, violent, abusive, profane, racist, discriminating, insulting, threatening, tortuous, harassing, hateful or otherwise objectionable;
11. deliver or provide links to, any postings containing defamatory, slanderous, false or libellous material;
12. deliver any posting that infringes or violates any intellectual property or other right of any entity or person, including, without limitation, copyrights, patents, trademarks, laws governing trade secrets, rights to privacy, or publicity;
13. deliver any posting that you do not have a right to make available under law or contractual or fiduciary relationships;
14. impersonate another person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity, or adopt a false identity if the purpose of doing so is to mislead, deceive, or defraud another;
15. manipulate identifiers, including by forging headers, in order to disguise the origin of any posting that you deliver;
16. use the Site in any manner which could damage, disable, overburden, or impair or otherwise interfere with the use of the Site or other users' computer equipment, or cause damage, disruption or limit the functioning of any software, hardware, or telecommunications equipment;
17. attempt to gain unauthorized access to the Site, any related website, other accounts, computer system, or networks connected to the Site, through hacking, password mining, or any other means;
18. obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site, including harvesting or otherwise collecting information about others such as email addresses;
19. engage in any deceptive practices intended to manipulate the organic Search Engine Results Page (SERP) or employ search engine optimization (“SEO”) techniques considered to be against common search engine guidelines. SEO practices considered unethical, or “black hat” (aka “spamdexing”) include, though are not limited to cloaking, meta data and title tags, content scraping, link schemes, Google bombs, keyword stuffing, hidden text and links, doorway and cloaked pages, link farming or schemes, blog comment spam, etc.;
20. do anything else which could cause damage to the Site, SoleAsia and its Corporate Affiliates, and their employees, SoleAsia’s reputation, or would otherwise have a negative impact;
21. hyperlink to any page beyond the homepage of the Site or frame the Site or any web page or material herein without express permission, nor hyperlink any aspect of the Site in an email for commercial purposes without the express written permission of SoleAsia;
22. not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell information, software, products, or services obtained from the Site; and/or
23. aid or abet any of the above.
Where you suspect your account, or booking has been closed, frozen or cancelled by mistake or would like to contest such action, please contact our Customer Service. For avoidance of doubt, SoleAsia retains the right to close any accounts and cancel any bookings made through their Site, for any reason whatsoever, at any time and shall not be liable for any action due to this. Where such action has been taken by SoleAsia, any payments made by the customer for the existing reservations shall be refunded back to the customer.
PRICING AND ADDITIONAL CHARGES
Unless indicated otherwise, all prices on our Site are only for your Accommodation room reservation only, and are for the number of people requested and for the requested stay dates. The Accommodation room reservation rates are displayed per room per night on the Site.
The rates displayed on SoleAsia Site are displayed exclusive of tax recovery and service charges, and these additional taxes and charges are displayed during the booking path. The total inclusive price shall be displayed prior to the confirmation of your booking, however subject to the terms as maybe stated below.
Please note that what is included in the rate displayed on the Site shall be available on the Site in the Accommodation information section or prior to the final booking confirmation. Breakfast or any other meals, or any other services is only included when explicitly stated so.
Please be aware that there may be certain Hotel Resort fee for the use of some of their services or other mandatory fees and certain local city, tourist or occupancy taxes that are required by law to be collected directly from guests, which will not typically be included in the rate unless stated otherwise. Please also be advised that you may also be charged directly by the Accommodation for energy surcharges, newspaper delivery fees, tourism fees, baggage handling fees, in-room safe fees or housekeeping fees. The Customer understands and acknowledges that such practice to add additional Accommodation fees is outside SoleAsia's control and occurs in certain markets. SoleAsia shall not be held responsible or liable for such additional charges that may be incurred by the customer.
For the sake of clarity, optional incidental fees and personal consumptions are almost never included, for example, parking charges, minibar charges, phone calls, room service, food & beverage, gala dinners, movie rentals, internet, etc. including compulsory gala dinners which may be applicable during high season periods.
For your information, in certain jurisdictions, the governments may issue additional taxes, or the law may require collection of a local bed or city tax from guests, which must be collected directly by the Accommodation itself. If applicable, such charges shall be payable by you to the Accommodation directly before checkout. For further clarity and verification on which extra fees are applicable to you which have not been included, please contact our customer services or the Accommodation directly.
Additionally, please note that insurance is never included in the rates.
Furthermore, our standard Accommodation room reservations are for single or double occupancy, and any extra beds, including children and adults, will usually incur an additional charge. The customer acknowledges and understands that where any additional persons joining are not duly informed in advance, the Accommodation reserves the right to refuse to accept such additional persons. SoleAsia cannot be held responsible for any repercussions faced by the customer at check-in due to the customers failure to inform the Accommodation in due time.
Please note that in some island destinations such as the Maldives, you may require the Accommodation suppliers to provide transportation to reach the Accommodation. It shall be the responsibility of the Customer to arrange such transport arrangements directly with the Accommodation or otherwise. As Soleasia does not organise or offer this accommodation transportation and it is offered by the Accommodation itself and/or it is to be separately arranged by the customer, the customer is responsible for the arrangement of such transportation services and not SoleAsia. For the avoidance of doubt, the Accommodation package offered by us does not provide the Accommodation transportation services unless otherwise stated.
CHARGE OF TAXES AND FEES
While facilitating your Accommodation transaction, please note that the charge to your credit card may also include a charge for taxes and fees. In relation to Accommodations, this charge includes an estimated amount to recover the amount SoleAsia pays to the Accommodation in connection with your reservation for taxes owed by the Accommodation, including but not limited to sales and use tax, occupancy tax, room tax, excise tax, value added tax, and other such taxes. The Tax amount may in some locations also include government imposed service fees or any other fees not paid directly to tax authorities but which the Accommodation is legally required to collect. The amount paid to the Accommodation in connection with your reservation for taxes may also vary from the amount that SoleAsia estimate and include in the charge to you.
Any balance on the charge for taxes and fees, is a fee that SoleAsia retain as part of the compensation for our services and to cover our administrative costs, including for an example customer service costs. Therefore, charge for taxes and fees varies depending on several factors such as the location, and may include profit that SoleAsia retains.
Except as described below, SoleAsia and its corporate affiliates are not vendors collecting and remitting taxes to the applicable taxing authorities. Our Accommodation suppliers, as vendors, include all applicable taxes in the amount billed and SoleAsia pay over such amounts directly to the vendors. Soleasia and its corporate affiliates are not co-vendors associated with the vendors with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location.
For transactions involving Accommodations located within certain jurisdictions, the charge to your credit card for taxes and fees include a payment of tax that Soleasia is required to collect and remit to the jurisdiction for tax owed on amounts Soleasia retain as compensation for services.
For Accommodations where you opt to pay at the Accommodation, the price may or may not include taxes and fees. Please verify the booking conditions and your confirmation mail. You may contact our Customer Service if you require further clarification.
As stated above, certain cities charge city, bed, tourist occupancy or equivalent taxes that have to be collected by the Accommodation locally.
SoleAsia Collects personal data about you that you provide us when using the Site. Such information includes but is not limited to your name, address, contact number, , e-mail address, accommodation name, location, and length of stay in accommodation. In addition, we may also collect other certain information including but not limited to your IP address, geographic data, your nationality and password on our Site, search preferences, which browser you're using, information relating to your computer's operating system, application version, and pages that have been shown to you. If you are using a mobile device, we may also collect data including but not limited to identifying your mobile device, device-specific settings, characteristics and geographical location details.
Protecting your information is very important to SoleAsia. Therefore, to prevent unauthorised access, we maintain reasonable physical, electronic and organisation procedures to ensure that we may protect your personal data from any accidental or unlawful destruction or accidental or unlawful disclosure or access. Additionally, with regard to protecting your credit card transactions, SoleAsia uses an international payment gate directly from the banks to ensure that your credit card details are secured and safe from any possible attacks on our Site.
Please note that your information shall only be shared by SoleAsia in the following circumstances. Primarily, your information will be shared with our business partners and Accommodation Suppliers to facilitate the services we provide to you. Furthermore, SoleAsia may also use your personal information in court as evidence against any claim made against SoleAsia to protect ourselves. For these purposes, it shall be in SoleAsia's sole discretion as to how much of your personal information may be shared with our business partners and accommodation suppliers in order to facilitate our services to you.
Please note that SoleAsia will only protect your personal information so far as SoleAsia is not required to disclose it by law, and SoleAsia cannot be held responsible or liable for such disclosure. Where such disclosure is required, disclosure of your personal information shall be limited to the minimum level of disclosure required by the law.
While SoleAsia makes protecting your personal information a priority, we shall not assume any liability for any costs or damages suffered by our customers where our security has been breached. The customer understands and agrees that SoleAsia shall not be held responsible for loss of their confidentiality.
PAYMENT, CREDIT CARDS AND FRAUD DETECTION
Payments method available differs from Accommodation to Accommodation, depending on the payment method the Accommodation chooses to list. As such two different payment methods are available on the site; payment to SoleAsia and Payment to Hotel.
For Accommodations requiring payment to SoleAsia, your credit card will be charged by SoleAsia for the full payment (sometimes without any option for refund depending on the Accommodations boking conditions) of the booking upon reservation.
For Accommodations requiring payment to Hotel, SoleAsia will not charge the full amount to your credit card, as you will pay directly to the Accommodation for your stay. A non-refundable nominal amount shall however be charged to your card to secure your booking. The customer shall pay the balance amount of the payment to the Accommodation within the period stipulated in the accommodation policy of the particular Accommodation and within a manner stipulated under the accommodation policy of the particular Accommodation. For avoidance of doubt, where the Customer fails to make the balance payment to the Accommodation as prescribed under the accommodation policy, the reservation may be cancelled and the nominal value paid will not be refunded. Where this payment method is opted, the Accommodation may require your credit card information, which must be shared by you directly to the Accommodation upon notification of the requirement of your credit card information by the Accommodation. For the sake of clarity, SoleAsia shall not be responsible for any costs incurred to you due to your failure to provide the credit card information with the Accommodation in time, and in such cases as well, the nominal value shall not be refunded due to any resulting cancellation of your booking.
For the sake of clarity, in order to safeguard your personal information your credit card details will not be collected or stored with SoleAsia. You will be feeding in your credit card details directly to the payment gateway of the Bank of Maldives Plc. Ltd to make the payment. Kindly note that your bank may impose additional fees on the transaction, over which SoleAsia has no control.
Where, for whatever reason, a refund is applicable and required, SoleAsia will process refunds within a reasonable timeframe. Kindly contact our Customer Services if you have any further queries regarding refunds.
Certain credit card companies charge their member banks a fee for processing "foreign transactions". If you make card transactions and the recipient uses a bank located in a different country other than the bank which issued your card, an international service assessment, cross-border transaction fee or similar fee may be charged. Your issuing bank may or may not pass this fee on to you (the card user). Please contact your issuing bank for details as this is outside the control of SoleAsia.
Where your credit card was used fraudulently or unauthorized use of your credit card was made by third parties, ensure that immediate contact is made with your bank or card issuer upon becoming aware of such use. Where unauthorized or fraudulent booking made via SoleAsia is suspected, please contact our Customer Services immediately.
By using our service or making a booking, you warrant that you are over 18 years old (or the age of majority in those countries and territories where it is higher than 18) and that you have the full legal capacity (or have the authorization from your legal guardian) to make the transaction. You also undertake that the debit or credit card you are using is your own or one that you are authorized to complete the booking with and that there are sufficient funds to cover the cost of the transaction, and you accept financial responsibility for all transactions made under your name or account. You warrant that the details provided by you in making a booking are fully correct.
SoleAsia reserves the right not to accept certain credit cards and may add or remove other payment methods at our discretion.
If, for variety of reasons, payment on the Site fails, SoleAsia will offer you alternatives to ensure your reservation can go ahead. Please contact our Customer Services for further questions.
SoleAsia utilizes strict fraud detection and prevention mechanisms. As explained in more detail on the Site, we may require further information or verifications to validate and confirm the bookings and a small verification charge or pre-authorization may be made to your card and the balance will be charged after confirmation.
reservations are not confirmed until you have received a confirmation mail with the details of the booking confirmed. Please note that an accommodation becoming fully booked during fraud check is a possibility and that in such an event the reservation will be no longer available and SoleAsia can never be liable in such cases. Strict industry standards will be applied regarding additional information submitted, and encryption and specialized agents will be used for transmission and verification. The booking will not be completed and fully cancelled and any amounts paid (including verification charges, where applicable) will be refunded if you choose not to submit the additional information or if we are not satisfied with the information received.
BOOKING CONDITIONS – CANCELLATIONS – NO SHOWS – EARLY DEPARTURE OR CHECK-OUT – SPECIAL NEEDS - SPECIAL ACCOMMODATION POLICIES – RESERVATION GUARANTEE
By making a booking on the Site, you accept and agree to the relevant Accommodation booking conditions, including cancellation and no-show policies and any additional terms and conditions of the Accommodation applicable to the booking, reservation or stay. The general cancellation and no-show policy for each Accommodation is made available on the Site and with the confirmation e-mail. Please ensure that you read the cancellation and no-show policy of the accommodation before you make a reservation, as you may be charged for your cancellation, in some cases for the entire stay or the first night, as per the Accommodations cancellation and no-show policy. Depending on the terms and conditions of the Accommodation, the remaining portion of your reservation will be cancelled without you being entitled to a refund if you fail to check-in to your accommodation on time on the day of your reservation and also fail to alert the Accommodation.
However, regardless of the Accommodations cancellation policy, SoleAsia reserves the right to charge a cancellation fee as indicated on the Site. Please ensure you read the Accommodations details carefully for the detailed conditions where stated
If you need to review, adjust or cancel your reservation, either follow the instructions in the confirmation e-mail or contact our Customer Services
Some Accommodations may also charge extra for early check-in and late check-out, and have specific policies concerning children, accompanying travellers and travelling with pets. Please refer to the Accommodation policies or contact with our Customer Services or the Accommodation directly.
Be informed that special needs requests (e.g., wheelchair accessible room) are subject to availability and cannot be guaranteed by SoleAsia. Please contact our Customer Service or the Accommodation to verify that special need requests can be met. In cases where your special needs requests cannot be met, your reservation will be refunded, cancelled or modified, depending on the policy of the relevant Accommodation.
Our customers are our top priority, and therefore any reservations made through SoleAsia is provided with a reservation guarantee. This means that if your confirmed reservation is not available, or your reservation was not honoured by the property upon arrival, please immediately contact our 24/7 Customer Service contact number, and our Customer Support Specialists will look for alternative Accommodations at a convenient and comparable property, for your approval. If for some reason we are unable to find an alternative accommodation for whatever reason, SoleAsia will provide a full refund of the price paid for the original accommodation.
INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHTS
You acknowledge and agree that all content included on this Site, including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sounds, images, illustrations, maps, designs, icons, written and other material (collectively, "Content") and the arrangement and compilation of the Content are intellectual property and copyrighted materials of SoleAsia and its suppliers.
In addition, all website materials, including, without limitation our logo, design, text, graphics, other files, and the selection and arrangement thereof are intellectual property and our copyrighted material.
Except as stated herein, these materials stated above may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without the prior express permission of SoleAsia or the respective copyright owner.
Permission is granted to display, copy, distribute and download the materials on this Site for personal, non-commercial and informational use only; provided that you may not, without SoleAsia's permission or the respective copyright owner, copy, publish or post any materials on any computer network or broadcast or publications media, change the materials or (c) remove or alter any copyright or other proprietary notices contained in the materials.

While we try our best to respect the copyright and intellectual property rights of others, we understand there may be situations where the Site may, unintentionally infringe on a third parties copyright. Any such copyright infringements are purely co-incidental. Therefore, if you believe that SoleAsia or any other content provider of our site has infringed your copyright in any material way, please contact us immediately with the following information so that we may attend to such a claim.
1. Signature of the person (physical or electronic) authorised to act on behalf of the owner of the copyright interest;

REVIEWS AND RIGHTS TO USER CONTENT
By successfully completing a booking through SoleAsia, you will be invited to complete our optional guest review form, promptly after your stay at the Accommodation. These reviews may be used on the Site as feedback for future customers to refer to concerning the quality and service at the Accommodation.
Without limiting the foregoing, SoleAsia reserves the right to use to content as it seems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. SoleAsia is also under no obligation to treat the content submitted by users as proprietary information and such information will be considered non confidential. SoleAsia reserves the sole discretion to decide whether to post the review submitted by the user on the Site or not, and in making that decision SoleAsia shall assess the usefulness of the review for prospective customers and its appropriateness.
SoleAsia shall have no duty to attribute authorship of content to you and shall not be obligated to enforce any form of attribution by third parties. TRAVEL ADVISORY – VISA REQUIREMENTS
We urge you to review travel prohibitions, warnings, announcements, and advisories issued by your government before booking travel, particularly when travelling to international destinations. By listing Accommodations in particular international destinations, SoleAsia does not represent or warrant that travel to such destinations is advisable or risk-free and can never be held liable for damages or losses that may occur from visiting such destinations. Personal travel insurance is also advised.
SoleAsia has no special knowledge regarding foreign entry requirements or travel documents. You are responsible for ensuring that you meet foreign entry requirements and that all required travel documents are in order. As such, you are advised to check with the relevant embassies, consulates and/or visa departments of the countries you wish to travel to. SoleAsia cannot be held liable for any loss incurred due to your failure to hold the necessary passports, visas and documentation for your travels.
It is your responsibility to verify and comply with regulations on the import of restricted or prohibited goods, items or substances applicable to the countries you are visiting. Such restriction or prohibition may apply but is not limited to alcohol, tobacco, perfumes, drugs, medication, books, movies, DVDs, adult entertainment materials, food stuff, plants, animal parts. Non-compliance can lead to severe penalties.
Please consult your doctor for the current inoculation recommendations for travel before you depart as it may have changed. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice regarding your trip.
Please contact our Customer Services, regarding any complaints you may have about SoleAsia’s service. While we will try our best to help you, please note that any complaints about the Accommodation is ultimately a matter for the Accommodation itself. This includes but is not limited to any complaints regarding policies, standards, service, facilities, decoration and food.
We will do our utmost best to address your concerns. soleAsia will directly co-odinate with the Accommodation, aiming to reach a mutually agreeable solution. However, the customer will understand and agree that SoleAsia cannot guarantee a satisfactory result since any complaints regarding the Accommodation such as their policies, standards, service, facilities, etc, can be eventually resolved by the Accommodation itself.
Claims should be submitted as soon as possible after occurrence of the event giving rise to the claim. Claims submitted after 1 month of event may be considered void and only bona fide claims shall be considered.

THE CUSTOMER UNDERSTANDS AND AGREES THAT SOLEASIA ASSUMES NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY ANY CUSTOMER, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA FROM DELAYS, NONDELIVERIES OF CONTENT OR EMAIL, ERRORS, SYSTEM DOWN TIME, MISDELIVERIES OF CONTENT OR EMAIL, NETWORK OR SYSTEM OUTAGES, FILE CORRUPTION OR SERVICE INTERRUPTIONS CAUSED BY THE NEGLIGENCE OF SOLEASIA, ITS AFFILIATES, ITS LICENSORS OR A CUSTOMER’S OWN ERRORS AND/OR OMISSIONS.
SOLEASIA ASSUMES NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY A CUSTOMER, INCLUDING, BUT NOT LIMITED TO, LOSS FROM NONDELIVERY OF SERVICES PURCHASED FROM ACCOMMODATIONS LISTED ON THE SITE. CUSTOMER IS AWARE THAT SUPPLIERS AND ACCOMMODATIONS ARE NOT IN ANYWAY RELATED TO SOLEASIA UNLESS OTHERWISE STATED BY SOLEASIA, AND SOLEASIA HAS NO RESPONSIBILITY TO ENSURE DELIVER OF SUCH SERVICES. THE CUSTOMER UNDERSTANDS AND AGREES THAT ANY SUCH DISPUTES OR CLAIMS SHALL BE RESOLVED BETWEEN THE ACCOMMODATION AND THE CUSTOMER DIRECTLY WITHOUT INVOLVEMENT OF SOLEASIA.
LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL THE 'COVERED PARTIES' BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, COMPENSATORY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY DAMAGES OR LOSSES WHATSOEVER, INCLUDING BUT NOT LIMITED TO (WHERE RELEVANT, CAUSED BY):
(I) LOSS OF REVENUE, LOSS OF CONTRACT, LOSS OF PROFIT, LOSS OF PRODUCTION, LOSS OF OR DAMAGE TO REPUTATION OR GOOD WILL, STRESS, DISTRESS, INCONVENIENCE, LOSS OF CLAIM, BUSINESS INTERRUPTION, DATA OR OTHER INTANGIBLE LOSSES;
(II) YOUR INABILITY TO USE, UNAUTHORIZED USE OF, DELAY, PERFORMANCE OR NON-PERFORMANCE OF THE SITE;
(III) TAMPERING WITH OR UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION OR TRANSMISSIONS;
(IV) THE PROVISION OR FAILURE TO PROVIDE ANY SERVICE, INCLUDING SERVICES RENDERED OR PRODUCTS OFFERED BY THE ACCOMMODATION, (PARTIAL) CANCELLATIONS OR OVERBOOKINGS;
(V) ERRORS OR INACCURACIES PROVIDED ON THE SITE OR ANY INFORMATION (INCLUDING BUT NOT LIMITED TO THE (DESCRIPTIVE) INFORMATION (INCLUDING RATES, AVAILABILITY AND RATINGS) OF THE ACCOMMODATION AS MADE AVAILABLE ON THE SITE), SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE;
(VI) ANY TRANSACTIONS ENTERED INTO THROUGH THE SITE;
(VII) ANY PROPERTY DAMAGE INCLUDING DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS, DURING OR ON ACCOUNT OF ACCESS TO OR USE OF THE SITE OR ANY SITE TO WHICH IT PROVIDES HYPERLINKS;
(VIII) DAMAGES OTHERWISE ARISING OUT OF THE USE OF THE SITE, ANY USE, DELAY OR INABILITY TO USE THE SITE, OR ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SITE;
(IX) ANY (PERSONAL) INJURY, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES ATTRIBUTABLE TO THE ACCOMMODATION (ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES OR AFFILIATED COMPANIES); OR/AND
(X) ANY DAMAGES CAUSED BY A FORCE MAJEURE EVENT.
THE LIMITATIONS OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
For avoidance of doubt, a force majeure event is any event beyond the Covered Parties’ control and can include, but is not limited to, natural disasters, weather, fire, nuclear incident, electro-magnetic pulse, terrorist act, riots, war, arson attacks, insurgency, rebellion, armed hostilities of any kind, labor disputes, lockouts, strikes, shortages, government actions or restraints, pilferage, bankruptcy, machinery breakdown, network or system interruptions or breakdown, internet or communications breakdown, quarantine, epidemic, pandemic etc. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority.
No Covered Party shall be responsible for any Accommodation’s breach of any condition or warranty including, but not limited to, implied conditions or warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of an Accommodation (including any liability in tort), as to any products and/or services available through the Site. SoleAsia do not guarantee continuous access without interruption to the Site.
The 'Covered Party' or 'Covered Parties' refer to SOLEASIA, as well as their directors, employees, officers, representatives, subsidiaries, corporate affiliates, distributors, suppliers, licensors, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its content.
The Accommodations listed on SoleAsia or any of the rooms in Accommodations are not in anyway, directly or indirectly, owned, managed, operated, or controlled by SoleAsia. The Accommodation is solely responsible and liable for providing accommodation services and welcoming people who have booked through the Site as their guests.
You shall at all times be bound by the local laws and regulations, and it shall be your responsibility to ascertain what is legal in the country you are visiting. you acknowledge and understand that SoleAsia will not be held liable where an Accommodation refuses to check you in or asks you to leave due to legal or regulatory reasons.
Where you use the Site for or on behalf of a third-party, such as a family member or friend, you are responsible for any error in the accuracy of information provided in connection with such use, and it shall be your responsibility to inform the third party of all applicable terms and conditions. Where the customer uses the Site for a third party, the customer agrees to indemnify and hold SoleAsia and its corporate affiliates harmless from and against any and all liabilities, losses, damages, suits and claims including legal costs relating to the third parties or the customers failure to fulfill any of its obligations as described above.
The Customer agrees that SoleAsia shall be indemnified and held harmless from and against any liability, damage or loss including legal fees and expenses that SoleAsia incur or suffer as a result of any action, inaction or omission by you.
Failure by SoleAsia to enforce a right does not result in waiver of such rights. You may not assign or transfer any of your rights.
Local tax receipts are only available from properties for bookings where payments are made at the property. For Bookings where the payment has been made to SoleAsia, SoleAsia can issue local invoices for bookings in Maldives since SoleAsia is a tax resident of Maldives, and also SoleAsia receipts for anywhere else.
